If you do not agree to the OBP Australia website Terms & Conditions then you should not continue to use the website. This is an Australian website.

  1. Terminology

In this document the terms, “you” or “user”, refer to the individual or businesses who uses the OBP Australia website.

The OBP Australia website www.obpAustralia.com.au is owned by ‘OBP Australia’ trading as OBP Australia, referred to as ‘OBP Australia’,’ ‘OBP’ ‘we’ or ‘us’ in this document. OBP Australia offers a range of services through www.obpaustralia.com.au   and through its office at 829A High Street Thornbury, Victoria 3017, Australia. We have contractors to whom we refer as ‘staff’,‘representative,’ ‘consultant’,‘employee’ or ‘team member’.

  1. Amendments to Terms

We reserve the right to amend these Terms from time to time. Amendments will be effective immediately upon their being posted on this page on this Website.  It is your responsibility to regularly check this page for any changes to the Terms and your continued use of the website will be deemed acceptance of those changes.

We reserve the right to withdraw the availability of the Website without notice.  These Terms will nevertheless survive any such termination

All OBP Australia material is protected by copyright and is not able to be copied or used in any way by you or any other party without permission from the OBP Australia author.

You may not reproduce upload, post, transmit or re-distribute any part of the OBP Australia content, or any material residing on www.obpAustralia.com.au. You may not use the content of this website for the teaching of students in a commercial environment or to distribute printed materials or audio content to any other party. OBP Australia videos are not to be copied or recorded.

All trademarks registered on this website are the property of OBP Australia. Any unauthorised use of the OBP Australia trademarks or any other images or content on this site is expressly prohibited. Except where otherwise specified in writing, any word or device to which is attached the TM or ® symbol is a trade mark.

Nothing contained on this Website shall be construed as granting any licence or right to use any trade mark without our prior written permission.

Access to webinars is for one user / individual only. An organisation must purchase a place for every individual. 

The sharing, copying or distribution of OBP Australia’s materials is strictly prohibited.

You will not use the site or the contents of this site for any purpose that is unlawful for the purposes of any state, federal or local law.

OBP Australia does not accept any liability for any error or omission. Use of content on this website is at your own risk.

6. Disputes

This agreement and this website shall be governed by and construed in accordance with the laws of the State of Victoria, Australia. All disputes arising out of or in connection with this Disclaimer shall be submitted to the exclusive jurisdiction of the courts of the State of Victoria, Australia.You agree to submit to the exclusive jurisdiction of the courts of that jurisdiction. If users access the Website from outside Australia they accept responsibility for ensuring or confirming compliance with all laws in that jurisdiction that apply to them as a result of that access or any consequent transactions or dealings with us, the Website or other users.

These terms may be varied from time to time at our sole discretion. Please ensure

that you review these terms regularly. Your continued use of the site will constitute acceptance of all variations to the terms and conditions.

We accept no liability for any failure to comply with these Terms where such failure is due to circumstances beyond our reasonable control. Any waiver of our rights under these Terms must be in writing.  If we waive any rights available to us under these Terms on one occasion, this does not mean that those rights will be waived on any other occasion. If any of these Terms are held to be invalid, unenforceable or illegal for any reason, the remaining Terms shall nevertheless continue in full force.We may transfer or sub license our rights and obligations under these Terms but you may not.

No refunds will be paid if you are unable to secure a work placement.

Terms & Conditions

7. Terminology

Participants who have purchased the Employment Preparation Premium Service Package may choose to undertake a ‘work placement’. A work placement may be referred to as, ‘placement’, ‘work experience’, ‘industry placement’ ‘industry work placement’, ‘industry work experience’ or ‘work experience placement’. ‘Host employer’ and ‘employer’ refers to the employer hosting the participant on work placement. (See section on ‘Work Placement’ for further details)

8. Payment for Services

By paying for the services of OBP Australia you enter into an agreement with OBP Australia and agree to be bound by the following terms and conditions.

The user shall pay for OBP Australia services in advance in accordance with the procedure and prices that are outlined on the checkout page of the OBP Australia website.

9. Work Placements

Participants

Work placements may be available to those who purchase the Employment Preparation Premium Service package. The purpose of a work placement may be to: gain local experience in your profession, develop your communication skills and understanding of Australian workplace culture or familiarise yourself with industry standards and codes in Australia.

OBP Australia does not charge a discrete fee to facilitate a work placement. The fee for the Employment Preparation Premium Service package covers the following services: needs analysis, resume/LinkedIn Profile, Key Selection Criteria, Cover Letter, Interview Skills Workshop, Networking Workshop, Preparation for Work Placement Workshop, 12 months’ consultancy support and introductions to industry professionals.

We do not guarantee that we can find a work placement for you, nor that you will be able to find an employer to host you on work placement.

It is compulsory to attend the Preparation for Work Placement session/workshop in order to be eligible for a work placement.

Prior to undertaking a work placement, the participant must sign a Work Placement Client agreement with OBP Australia. We will not held liable for any breach of the Fair Work Act by the host employer.

OBP Australia does not accept liability for financial loss incurred as a result of insurance premiums paid by the participant. The onus is on the participant to seek recompense, if eligible, from the insurer. The onus is on the participant to understand his/her rights in relation to refunds under the insurance policy terms. OBP Australia will not be liable in relation to any disputes with the Insurer or host Employer.

There is no guarantee that you will be offered paid employment at the end of the placement period. In fact, you should not have the expectation of securing employment with the host employer. The purpose of a work placement may be to: gain local experience in your profession, develop you communication skills and understanding of Australian workplace culture or familiarise yourself with industry standards and codes in Australia.

In order to undertake a work placement, the OBP Australia client is required to take out work experience insurance cover through IC Frith Pty Ltd. OBP Australia may assist you in your application for insurance, but the policy is an agreement between you and the insurer. The onus is on the client/participant to supply the host employer with details of the insurance policy and the Certificate of Currency.

OBP Australia may assist in facilitating a work placement by liaising with employers and offering advice on how to secure work experience insurance, but does not accept liability for claims or disputes over coverage. Participants will need to submit the application for insurance online and the onus is on the participant to understand the details of policy coverage.

All participants undertaking a work placement must have completed, signed and submitted the work placement conduct paperwork to OBP Australia prior to the commencement of a placement. The host employer will require from you, before work placement commencement, the Certificate of Currency as proof that you have insurance cover for the duration of the work placement.

Participants must receive approval via email from OBP Australia to undertake a placement before commencing a work placement.

Participants on placement must conduct themselves in a professional manner and not breach the law in relation to privacy and confidentiality.

Participants must comply with company OH&S requirements.

Host Employers

Placements are unpaid.

There is no obligation, nor expectation, that the host employer will offer paid employment at the completion of the placement.

OBP Australia recommends a placement of up to three weeks maximum duration. Start & finish dates must be agreed prior to the participant's application of insurance coverage.

There is no fee payable to OBP Australia for the placement referral. Should the host employer offer paid employment beyond the duration of the placement, there is no fee payable to OBP Australia. The placement is cost free to the employer.

Any paid employment arrangements made between the participant and the employer beyond the duration of the placement shall be an agreement between the employer and participant. OBP Australia accepts no liability for employment terms & conditions and will not play any part in the negotiation of employment terms and conditions.  

Should the host employer wish to employ the participant prior to the end of placement period, all placement arrangements shall cease and the participant will become an employee.

Host employers must conduct an OH&S induction prior to the commencement of the work placement.

Host employers shall comply with the Fair Work Act 2009.

Work Experience Insurance

Work experience cover shall be obtained by the participant through IC Frith & Associates Insurance Brokers, underwritten by The Hollard Insurance Company Pty Ltd. IC Frith & Associates Insurance Brokers has been chosen as the preferred insurer because of its expertise in work experience insurance. OBP Australia will not support a work placement with insurance from any other insurer.

The employer shall receive the insurance Financial Services Guide (FSG) and Product Disclosure Statement (PDS) prior to agreeing to host a work placement. The onus is on the host employer to ensure that the cover adequately meets their needs. Employers are encouraged to contact IC Frith Pty Ltd directly should they have any questions regarding insurance cover.

Both the Insured Person and host employer supervisor must keep a log of all days worked so that in the event of a claim they can be submitted to the insurer. OBP Australia will provide both the host employer and participant with a work placement diary proforma which can be used to log days worked on placement. The employer can choose to use their own diary record if they prefer.

The host employer must receive the Certificate of Currency, as proof of the participant’s insurance coverage for the duration of the work placement, prior to the commencement of the placement.

10. Employment Preparation Documents

Employment preparation documents may include: resume, cover letter, key selection criteria, email messages to employers and LinkedIn profiles. All advice given OBP Australia in relation to employment preparation documents is based on information provided by you. We do not conduct checks of the information provided by you and accordingly we do not give any warranty or assume any obligation to you or any other party that our product or services are appropriate for your intended purposes or use by any other party for any purpose.

Gaining employment is subject to numerous variables beyond our control and to factors substantially unknown to us. Accordingly we provide no warranty that our products or services will guarantee or contribute to your success in gaining employment. We accept no liability for your failure to gain employment or lost opportunities.

Any information relating to you is treated by OBP Australia in accordance with the OBP Australia Privacy Policy as attached.

Intellectual Property - The style and content and all other aspects of our website, products and services are the Intellectual Property of OBP Australia and we reserve the right to protect it at law including Trade practices, Copyright, Trademark, etc., against any un-authorised use.

Processing of orders for OBP Australia Services will commence on receipt of the Fee in accordance with our scheduled Fees as applicable from time to time.

11. Refund Policy

Once a user purchases any of the following OBP Australia services, the sale is final, and no refunds will be available.

  • Employment Preparation: Basic& Standard Packages
  • Mentoring
  • Interview Coaching
  • Professional Writing
  • Pronunciation
  • Networking

Refunds are available for the Employment Preparation Premium Service Package as follows:

  • 100% refund if we receive notification of withdrawal via email within 14 days of payment and you have not received an OBP Australia sample resume, a draft modified resume from OBP Australia and have not attended any workshops or webinars.
  • 80% refund if we receive notification of withdrawal via email within 7 days of payment and you have received an OBP Australia sample resume, a draft modified resume from OBP Australia or you have attended a workshop or webinar
  • 50% refund if we receive notification of withdrawal via email within 14 days of payment and you have received an OBP Australia sample resume, a draft modified resume from OBP Australia or have attended a workshop or webinar.
  • No refunds will be issued after 14 days from the date of payment
  • No refunds will be issued for non-attendance at workshops
  • No refund will be issued for cancelled workshops.
  • Cancelled workshops and webinars will be rescheduled.
  • No refunds will be issued for non-attendance at rescheduled workshops and webinars

Your commencement date’ refers to the date of your first scheduled workshop or webinar.

‘Date of payment’ refers to the date of OBP Australia receiving your payment for services.

Refunds are available for the Workplace Communication Skills service/workshops as follows:

  • 100% refund if we receive notification of withdrawal via email 48 hours prior to the commencement date
  • 90% refund if we receive notification of withdrawal via email within 14 days after your commencement date and you have not attended any scheduled workshops or webinars
  • 50% refund if we receive notification of withdrawal via email within 14 days after your commencement date and you have attended any scheduled workshops or webinars
  • No refund will be issued for withdrawals after 14 days from your commencement date
  • No refund will be issued for non-attendance at workshops or webinars
  • No refund will be issued for non-attendance at rescheduled webinars and workshops
  • Cancelled webinars and workshops will be rescheduled

Paid Webinars

  • No refund will be issued for non-attendance at webinars
  • No refund will be issued where technical problems prohibited your attendance
  • Cancelled webinars will be rescheduled
  • No refund will be issued for non-attendance at rescheduled webinars
  • A 50% refund will be issued if notification of non-attendance is received, via email to enquiries@obpaustralia.com.au, 72 hours prior to the scheduled webinar

Please ensure you have an adequate computer and internet connection to access Skype and GoToWebinar. The quality of your internet connection is dependent on many factors. While we strive to provide you a high quality viewing experience, we make no guarantee as to the resolution or quality of the service you will receive when streaming, attending webinars or communicating via video over IP (Skype, etc.).

12. Disputes

In the event that a service is withdrawn from the OBP Australia package list, you may apply for the refund of the service fee, however, no other compensation or remedy shall be available.

On receipt of a registration and payment receipt, a letter of acknowledgement will be sent by email to the user.

Within 24 hours following payment the user will be sent an email confirming payment and instructions on how to access the service.

Any notification to the user will be deemed effective if sent by email to the last known email address of the user.

OBP Australia reserves the right to alter our pricing structures listed on our website at any time. Naturally we will always do our best to give adequate notice. Once a service is commenced by a user, the pricing structure will remain the same for the duration of the subscription or service  for that particular user.

In the event the user breaches a term or condition of this agreement OBP Australia has the right to cancel this agreement and the user’s license to use the services purchased.

If OBP Australia believes the user is breaching or has breached the terms of this agreement, OBP Australia reserves the right to cancel and remove user access. In such cases a refund will not be issued.

In the event that you breach a term or condition of this agreement, OBP Australia reserves the right to commence proceedings to recover damages against you.
